Terms and conditions

§ 1 Scope and provider

These terms apply to all orders placed via the online shop futuresnutrition.de. The provider and contracting party is MB Top Futures, Chemijos g. 27C-62, LT-51349 Kaunas, Lithuania (hereinafter the “seller”). The offer is addressed to consumers and businesses.

§ 2 Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order. By clicking the order button (“order with obligation to pay”) you submit a binding offer. The contract is concluded when we accept the order by an order confirmation by email or by delivering the goods.

§ 3 Prices and shipping costs

All prices include statutory VAT. In addition to the stated product price, shipping costs apply unless the order value for free shipping is reached. The shipping costs and the relevant threshold are shown during the order process and depend on the delivery country (shipping zone). Shipping is from our warehouse in Germany or within the European Union.

§ 4 Payment

Payment is made using the methods offered during the order process (for example credit card, PayPal, advance bank transfer). The purchase price is due on conclusion of the contract.

When paying by advance bank transfer the invoice amount must be transferred within 7 days of the order date to the account stated in the order confirmation; please give the order number as the payment reference. Dispatch takes place only after payment has been received in full. If no payment is received within 14 days of the order date, we are entitled to withdraw from the contract and cancel the order; no costs arise for the customer. We send an email reminder about the outstanding payment beforehand.

§ 5 Delivery

Delivery is made to the delivery address given by the customer within the countries we serve. Stated delivery times are non-binding guide values unless a binding date has expressly been promised. For deliveries outside the EU, additional customs duties, taxes or charges may apply, to be borne by the customer.

§ 6 Retention of title

The goods delivered remain our property until payment has been made in full.

§ 7 Right of withdrawal

Consumers have a statutory right of withdrawal. The details are set out in the separately provided withdrawal policy.

§ 8 Warranty / liability for defects

The statutory provisions on liability for defects apply. In contracts with businesses, the warranty period for new goods is one year from the transfer of risk.

§ 9 Note on the products

Food supplements are not a substitute for a varied and balanced diet and a healthy lifestyle. The stated recommended daily intake must not be exceeded. Keep products out of reach of young children.

§ 10 Liability

The seller is liable without limitation for intent and gross negligence as well as for injury to life, body and health. In the case of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical of the contract. Otherwise liability is excluded.

§ 11 Dispute resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

§ 12 Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a consumer habitually resident in another EU state, the mandatory consumer protection provisions of that state remain unaffected. Should any provision of these terms be invalid, the validity of the remaining provisions remains unaffected.
